Terms and Conditions of Sale

 

1.  Application

1.1 These Terms apply to all goods supplied by DANCORE PTY LTD (Dancore).

1.2 By placing an order, the purchaser (Customer) agrees to these Terms.

1.3 Any terms contained in a purchase order or other document issued by the Customer do not apply unless agreed in writing by Dancore.

2. Quotations

2.1 Quotations are valid for fourteen (14) days unless stated otherwise.

2.2 All prices are in Australian Dollars and exclusive of GST unless specified.

2.3 Prices are based on material and freight costs at the time of quotation. Dancore reserves the right to adjust pricing where material costs, freight costs or specifications change prior to supply.

3. Orders and Specifications

3.1 The Customer is responsible for ensuring that all measurements, specifications, drawings and technical information provided to Dancore are accurate.

3.2 Dancore manufactures custom and fabricated goods strictly in accordance with the information supplied by the Customer.

3.3 Dancore is not liable for losses arising from incorrect specifications supplied by the Customer.

3.4 The Customer is responsible for determining that the goods are suitable for their intended application.

4. Payment Terms

4.1 Payment terms are as agreed with each Customer and stated on the invoice (typically 7, 14 or 30 days from invoice).

4.2 All amounts must be paid in full by the due date stated on the invoice.

4.3 GST is payable in addition to the quoted price where applicable.

5. Delivery and Freight

5.1 Unless otherwise agreed, Dancore will arrange freight on behalf of the Customer and freight charges will be invoiced accordingly.

5.2 Delivery dates are estimates only and are not guaranteed.

5.3 Dancore is not liable for delays caused by events outside its reasonable control, including supplier or freight delays.

5.4 Risk in the goods passes to the Customer upon dispatch from Dancore’s premises or collection by the Customer.

6. Title

6.1 Title to the goods remains with Dancore until payment has been received in full.

6.2 Until title passes, the Customer must keep the goods identifiable and not encumber them.

7. Inspection and Claims

7.1 The Customer must inspect goods upon delivery.

7.2 Any claim for shortage, damage or defect must be made in writing within seven (7) days of delivery.

7.3 Failure to notify Dancore within this period constitutes acceptance of the goods to the extent permitted by law.

8. Returns

8.1 Returns require prior written approval from Dancore.

8.2 Custom-fabricated, made-to-order or cut materials are non-returnable except where defective or required under Australian Consumer Law.

9. Warranty

9.1 Dancore warrants that goods will comply with agreed specifications at the time of supply.

9.2 This warranty does not apply to issues arising from misuse, improper installation, modification, normal wear and tear, or exposure to unsuitable operating conditions.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, Dancore’s liability is limited (at its option) to replacement, repair, or refund of the purchase price.

10.2 Dancore is not liable for indirect or consequential loss, including loss of profits, production downtime or loss of contracts.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights under the Competition and Consumer Act 2010 (Cth).

12. Force Majeure

Dancore is not liable for failure or delay in supply caused by events beyond its reasonable control.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia.
